Decks and patios are allowed only in side and rear yard areas, but shall be no closer than ten (10) feet to a side lot line or rear lot line. An exception is along the common property line where there is a common wall for single family attached dwellings and semi detached dwellings where decks and patios will be permitted within the property boundaries up to the property line. Permits are required.
All permit applications must be picked up at the Township Permit Dept.: Monday - Friday (8:00am-4:00pm)

Submission requirements for 30" and higher:
  • Building permit
  • Application review fee $40.00 (non-refundable)
  • Plot plan, showing location of deck on house and setbacks (distance) from property lines.
  • 2 sets --Detail drawings
  • Certificate of Insurance of Workers Compensation Insurance for contractors
  • Zoning setback - 10 feet from side & rear property lines without roof
  • With roof - must meet setbacks for that property as well as lot coverage

Inspection requirements:
  1. Post holes----- 36 inches deep (frost depth) - minimum 12 inches across - before pour or placement of posts.
  2. Fasteners: nails, bolts, and joist hangers, etc. for pressure preservative treated wood MUST USE hot-dipped galvanized steel, stainless steel, silicon bronze or copper.
  3. Flashing required to provide drainage away from connections
  4. Frame inspection required for any deck less than 4 feet in height (before deck boards are installed).
  5. Final ---------- deck completed with stairs and handrails where applicable.
  6. Deck attached to house with lag bolts that must penetrate into solid rim joist or carriage bolts with nuts and washers for OSB rim joists.

Fences/Walls

Fences and walls shall not exceed six (6) feet in height in front yard areas, provided that such fence does not unsafely obstruct the view of a vehicle operator entering or exiting a driveway, and further provided that no portion of the fence in excess of four (4) feet in height encroaches farther into the front yard on which the residence faces than the place created by the front of such residence, and eight (8) feet in height in all other yard areas (except tennis court fences which may not exceed ten (10) feet in height). Fences and walls shall be no closer than two (2) feet to a property line unless there is a letter of consent from the adjacent property owner in which case they may be positioned on the property line. In no case shall any fence or wall be located in the existing street right-of-way or interfere with a clear sight triangle as described in Subsection 1602.5. An exception is along the common property line where there is a common wall for single family attached dwellings and semi detached dwellings where fences will be permitted within the property boundaries up to the property line.

Sheds

Storage sheds (one hundred, forty-four (144) square feet or less), swing sets, play structures and the like, are allowed only in side and rear yard areas, and may be no closer than five (5) feet to a side or rear lot line. Accessory buildings, larger than 144 square feet, see private building requirements below. Skate board ramps must meet required setbacks. Permits are required.

Miscellaneous

For re-sales, inspections and certificate of occupancy is "not" required in Lower Macungie Township.

A detached garage or carport shall be allowed no closer than between ten (10) feet to a rear or side lot line unless the dwelling unit has a common wall structure. An exception is along the common property line where there is a common wall for single family attached dwellings and semi detached dwellings where a garage and deck will be permitted within the property boundaries up to the property line.

Private buildings and structures such as tennis courts, private bath houses (serving only pools accessory to principal residences) and greenhouses are allowed only in side and rear yard areas, and shall be no closer than ten (10) feet to a side or rear lot line and shall be buffered by landscaping from adjacent property.

Propane – Electric, Zoning permits required. Plot plan showing location of propane tank and 2 sets of manufacture’s specifications.
 
Permits available at the Township permit department.  Review and inspections conducted by the Township’s 3rd party agency.
 
Pre-fab slabs do not need a permit, however a “poured” slab will require a zoning permit for location on property.

Peddling and Solicitation Permit

For the protection of Lower Macungie Township residents, Codified Ordinance Chapter 13, Part 1, establishes rules and regulations for any persons soliciting and peddling items and services door-to-door throughout the Township:
 
  1. The Township shall license all peddlers and solicitors. Each individual soliciting or peddling shall carry the license with them at all times.
  2. The peddler or solicitor shall have photo identification, such as a driver’s license, with them at all times and shall exhibit it at the homeowner’s request.
  3. If a property is posted NO PEDDLING OR SOLICITING the peddler or solicitor shall not enter the property.
  4. The peddler or solicitor shall not enter any dwelling without the homeowner’s request.
  5. The peddler or solicitor shall only engage in peddling Monday thru Saturday during daylight hours.
  6. The peddler or solicitor shall not engage in any activity that creates a nuisance or disrupts traffic.
Persons going door-to-door canvassing about religious or political subjects however, are exempt from these requirements. Public charities, local churches, scout troops, civic and service organizations, fire companies, athletic organizations and the like are also exempt.
 
Please remember that these regulations only apply to individuals making verbal contact with residents. Individuals distributing flyers or brochures are not required to get a license from the Township.
 
As a precaution we recommend that you should not let anyone who is soliciting or peddling without a permit issued by LMT and a photo ID into your home.
 
If you see anybody peddling or soliciting without a permit, PLEASE notify the Township's Code Enforcement Officer (610-966-4343) or the PA State Police (610-395-1438) immediately.
